Professional Experience:

First: Experiences in the Governmental Sector

-Dr Mohammad started his career as Deputy Attorney General for a period of nine years during which he investigated numerous complaints and criminal reports at divisional and qualitative prosecution branches. This enabled him to gain a deep insight in all aspects and applications of the Criminal laws in the State of Kuwait. In this regard, he received a number of training courses within and outside Kuwait, particularly in matters related to crimes against the public funds and methods of combatting them and prosecuting their perpetrators.

-In 1999, Dr. Mohammad was appointed judge at the Court of First Instance where he participated in and headed several diversified courts and judicial bodies – civil, commercial and penal, at the Court of First Instance. He issued many judgments that contributed to polishing and developing his law experience in the writing and justifying judicial verdicts. On several occasions during his judicial career, he supervised elections of the National Assembly and Municipal Councils and headed many electoral committees in this regard.

-In addition to his judicial work, Dr. Mohammad was delegated in 1999, as legal adviser to the Deputy Prime Minister and Minister of State for Council of Ministers Affairs and Minister of State for National Assembly Affairs. In this position, he participated in a large number of ministerial meetings and provided legal advice in a wide diversity of legal matters. During this period, and in addition to his consulting work, he was assigned the functions of the manager of the Department of Following Up Law Proposals and Drafts at the Ministry of State for National Assembly Affairs and presented a large number of legal memoranda expressing his opinion on proposals and draft laws presented before the National Assembly, thereby deepening his legal experience in various aspects of the legislative process and enhancing his knowledge of the various legislations and laws in the State of Kuwait.

Second: Professional Progress in the Privet Sector

-In 2002, Dr Mohammad opened the doors to his legal firm, Menwer & Associates, which within a few short years, became one of the most rapidly growing, prominent law firms within the State of Kuwait.

-In 2012, Dr. Mohammad established Menwer Debt Collection Company, which achieved a remarkable growth within a very short period of time to occupy a prominent position among companies in this industry, and to be placed in the top position by several of its customers within the telecommunication and banking industries. Kuwait Finance House has recently assigned to the company the collection of its customer debts in the local market, this being one of the largest debt portfolios in the Kuwaiti market.

-In 2015, The Legal 500, the international professional guide of classifying lawyers around the world, ranked Menwer & Associates among the best law firms in Kuwait Corporate, Commercial and M&A and Dispute Resolution. Mohammad was selected as a recommended lawyer in the commercial and corporate and dispute resolution fields in Kuwait.

-In 2015 Menwer & Associates received ISO 9001-2001 certification for legal services and debt structuring.

-In the course of his professional career, Dr. Mohammad has represented many banks and public shareholding companies, private companies and government institutions. He provided advice to the boards of directors of Kuwaiti, GCC and Global companies and banks, and advised the government and many public institutions and companies, including, without limitation, the Public Authority for Investment, Public Institution for Social Security, Kuwaiti Airways Co., Wafra Real Estate Company and Al Markkas Al Dawly Company.

-Mohammed has also provided specialized advice to many local and foreign banks including Kuwait Finance House, Bobyan Bank, Kuwait International Bank, Abu Dhabi Commercial Bank, HSBC bank and Barclays Bank and a number of financial institutions with investment activities, both in Kuwait and abroad.

-Mohammed has established a professional cooperation with Norton Rose Fulbright, a leading international law firm. Through this professional cooperation, Mohammed was able to extend his legal services beyond the local market by providing world class legal advice to a large number of international companies and institutions. This professional alliance undertook several highly important joint projects in Kuwait to include: -

  • -providing legal advice to Kuwait Medical City Company which plans to design, build and operate the largest integrated medical city in Kuwait; and

    -legal assistance to Land & Housing (HL) Company which is wholly owned by the Government of South Korea to open an office in Kuwait under the privileges provided by the Foreign Investment Law, with a mission to design, develop and build the first smart residential city in Kuwait in South of Saad Al-Abdullah City.

Mohammad has also provided his legal services to various economic entities and private and family commercial companies including Al-Imtiyaz Group of Companies and Fouad Alghanim & Sons Group of Companies. In the energy sector, Mohammad acquired a fair knowledge and expertise in which he developed through advising several local and international corporations including among others Chevron, Sinopec, Taihan and Triple E.

Mohammad's career as a lawyer is highlighted with various legal achievements and technical success in varied legal areas. He has placed his unique mark on the legal practice which he crowned in 2003 by obtaining a judgment from the Constitutional Court that found that several articles of the Penal Law Code were unconstitutional. This resulted in a clear modification of several legal principles that had been adopted by the Kuwaiti Penal Law.

Mohammed has participated in establishing many large commercial companies and establishments in Kuwait including Kuwait Telecommunications Company (VIVA), Kuwait Medical City Company with a capital of KD200 million, which is wholly owned by the Kuwaiti Government.

In 2011, the Public Authority for Investment, on behalf of Viva and Ororedoo telecommunications companies, commissioned Dr. Mohammad to challenge the decision of the Minister of Communications concerning increasing the mobile telecommunications services tariff. In an intense court battle with the Ministry of Communications, this ended with the issue of a final judgment by the Administrative Cassation Court cancelling the controversial ministerial resolution and resulting in huge financial benefits to the two companies in tens of millions of Dinars.

In 2014, Menwer & Associates won a tender for providing legal services to Kuwait Airways Company, having been among a short list of Kuwaiti law firms qualified for this tender. In this regard, Mohammed provides specialized legal advice to Kuwait Airways and its Board of Directors in their efforts to increase the size of the KAC's fleet. In the process, he has drafted and reviewed many international contracts and agreements with major global airline companies. Mohammed continues to represent a number of major companies and individuals in various sectors of investment, banking, insurance, communications, technology, real estate, aviation, contracting, tendering and retail within and outside Kuwait.

Mohammed has defended and pleaded in some of the most prominent and important penal lawsuits and administrative disputes at various judicial levels in the State of Kuwait. Mohammed has initiated a number of landmark constitutional appeals that led to the cancellation of the results of the National Assembly elections in 2008 and 2009.
