This Checklist considers the principal steps during the start of arbitration proceedings under the 2021 International Chamber of Commerce (ICC) Rules of Arbitration (ICC Rules). If commencing arbitration, the claimant should consider:

A party requiring urgent relief may commence emergency arbitrator proceedings (ICC, App V, art 29). | The claimant will send the Request to each party, each arbitrator and the Secretariat, unless the claimant requests that the Secretariat transmits the Request by delivery against receipt, registered post or courier (ICC, arts 3(1) and 4(4)(b)). The claimant's Request for Arbitration (Request) will be received by the ICC Secretariat (with filing fee) | The respondent will file with the Secretariat the Answer to the Request (Answer) and any counterclaims within 30 days of notice of Request from the Secretariat (ICC, arts 5(1), 5(5)) |
