Snagging Clause

Drafting Note

The term ‘snagging' refers to minor defects that are required to be corrected by a contractor either before or following completion. The concept is not normally provided for in the standard forms but it is common practice for the Architect/Contract Administrator (or other certifier) to identify minor works that must be completed as soon as possible after practical completion by way of a ‘snagging list'. The benefit is that practical completion can be awarded notwithstanding the requirement for the contractor to rectify defects afterwards. This drafting is an additional clause that may be included in a bespoke building contract or added to a schedule of amendments to clarify the timeframes for completion of any such snagging items. When using this Precedent clause, ensure that any defined terms are consistent with the remainder of the contract.

Snagging

1 The Architect/Contract Administrator may deliver to the Contractor as an instruction a schedule of any incomplete items of work and defects outstanding at the date of issue of the Practical Completion Certificate or Section Completion Certificate which the Architect/Contract Administrator requires to be completed or made good immediately following issue of the same.
