Practical Completion Definition
Definitions for use in a building contract
‘Practical Completion' means a state in which the Works or any Section thereof are complete in all respects and free from apparent defects, save for any minor items of incomplete work or minor defects and/or blemishes, the existence, completion or rectification of which would not, in the reasonable opinion of the Employer, prevent or interfere with the beneficial use and/or enjoyment of the Works or Section by the Employer, the Beneficiaries and/or any purchasers or lessees from them. Provided always that where the Contractor is required to test and/or commission the Works, or a Section or any part or parts thereof, the Works or Section shall not be regarded as having achieved Practical Completion until such time as the Contractor has carried out and completed the requisite testing and commissioning to the reasonable satisfaction of the Employer and has provided the Employer with copies of the records and/or test certificates evidencing the results of such testing and/or commissioning.
