This Precedent is a suggested definition for ‘know-how’, which is a term commonly used in agreements. Know-how is not strictly a form of property in its own right, although it is often treated as a form of intellectual property. It may be more accurate to describe know-how as information (particularly technical information) that may be protected under the law of confidence. Know-how can arise in many forms and may be held by a particular person or company.
