Fitness for purpose warranty

1 The Contractor warrants to the Employer that the Works will be fit for their purposes as made known to the Contractor by the Contract.

2 The Works shall, when completed, comply with the Employer's Requirements, including (without limitation) any performance specification or requirement included therein or to be reasonably inferred therefrom as well as with any relevant requirements in planning conditions.

Fitness for purpose—exclusion

1 Notwithstanding any other provision, nothing in this Contract or otherwise shall imply that the Contractor's design or any part of it will, when completed, be fit for the purposes for which it is required by the Employer, as made known to the Contractor by the Contract.
