Clause
1 Dispute resolution—short form
1.1 If any dispute arises between the parties out of, or in connection with, this Agreement, the matter shall be referred to identify level of senior representatives of each party who shall use their reasonable endeavours to resolve it.
1.2 If the dispute is not resolved within 14 days of the referral being made under clause 1.1, the parties shall OR may resolve the matter through mediation.
1.3 Either party may issue formal legal proceedings or commence arbitration at any time whether or not the steps referred to in clauses 1.1 and 1.2 have been completed. OR Until the parties have completed the steps referred to in clauses 1.1 and 1.2, and have failed to resolve the dispute, neither party shall commence formal legal proceedings or arbitration except that either party may at any time seek urgent interim relief.
2 Dispute resolution—long form
2.1 Any dispute arising between the parties out of or in connection with this Agreement shall be dealt with in accordance with the provisions of this clause 2.
