This Comparative Note summarises the most important legal provisions on maternity and paternity leave in mainland UAE, DIFC, and ADGM.

The Note covers Federal Decree-Law No. 33/2021 On Regulation of Labour Relations, DIFC Law No. 2/2019 DIFC Employment Law, and the ADGM Employment Regulations 2019.

Definitions

  • ADGM: Abu Dhabi Global Market.

  • DIFC: Dubai International Financial Centre.

  • Maternity leave: A period granted to a female employee who is about to have a child or just had a child to remain away from work to recover from the delivery and to create a bond with her new child; or the leave period a female employee is entitled to under the law; or such greater period as may be provided by an employer to an employee under an employment contract.

  • Maternity pay: The payment made by an employer to an employee during maternity leave.
