Disputes with Employees

Drafting notes

This document is currently being updated in light of Federal Decree-Law No. 33/2021 on Regulation of Labour Relations and Cabinet Decision No. 1/2022 on the Implementing Regulation of Federal Decree-Law No. 33/2021.

Overview

This Practice Note dwells upon the notable disputes that the employers can get into with their employees in the Dubai International Financial Centre (DIFC). The employer-employee relationship in the DIFC is wholly governed under the DIFC Law No. 2/2019 DIFC Employment Law as amended from time to time, therefore, any dispute arising out of such relationship is dealt under the relevant provisions of DIFC Law No. 2/2019. In the interest of brevity, this Practice Note divides the employers' disputes with their employees into following three prominent categories:

  • disputes related to the termination of an employee;

  • disputes related to the post termination payments; and

  • disputes arising out of discrimination and victimization of an employee at the workplace.

The above-mentioned categories will be discussed in a seriatim below followed by the available mechanism of resolution of these disputes in the DIFC.
