Overview

  • The DIFC-LCIA Arbitration Centre was dissolved in September 2021 as per Dubai Decree No. 34/2021. Its operations and assets have been emerged into a Dubai International Arbitration Centre (DIAC). Ownership of real estate, assets, funds, staff, financial allocations and membership base will also be transferred to the new Centre.

  • This Practice Note deals with the 2016 rules and procedures of the former DIFC-LCIA Arbitration Centre.

  • This Practice Note considers the award under the DIFC-LCIA Arbitration Rules 2016, which apply to arbitration proceedings commencing on or after 1 October 2016. The 2008 version of the Rules is available on the institution's website.

Practical Guidance

Approach to awards and choice of seat

The Rules do not provide for the institution to scrutinise awards. Only basic checking is carried out and it is the responsibility of each tribunal to render awards in compliance with the law of the seat of arbitration and the Rules. Arbitrators can request the secretariat to carry out a final proofread of their awards and sole arbitrators, in particular, may find this to be a helpful service. Sufficient notice should be given of any request for proof-reading.
