ADCCAC – The Award

Overview

  • An arbitration agreement which provides for arbitration under the ADCCAC will be conducted under its 2013 Procedural Regulations of Arbitration (the 2013 Regulations).

  • For the purposes of enforcement, it is vital that the arbitral award complies with all the requirements of the rules under which it is made.

  • Note that the provisions apply to any arbitral award, not just a final award (the Panel (the ADCCAC term for the tribunal) may render a provisional, partial or final award article 28(1).

  • Awards must be distinguished from procedural orders, which under the 2013 Regulations (and often in practice in any event), if the parties, or all members of the Panel in the case of three arbitrators, agree may be issued by the president of the Panel alone article 28(3).

  • The award must not be published without the parties' consent article 28(8).

Definitions

  • ADCCAC: The Abu Dhabi Commercial Conciliation & Arbitration Centre.

  • The Centre : This term is used interchangeably with the ADCCAC. Notifications are sent to the Centre marked for the attention of the Director article 4.

  • The Director: The director of the Centre.
