Federal Decree-Law No. 48/2023 (the New Insurance Law), which replaced Federal Law No. 6/2007, brought about certain key changes in respect of the forum and procedure for the resolution of insurance disputes within the UAE (outside of the Financial Free Zones). Article 110 of Federal Law No. 6/2007 had established the Insurance Settlement Dispute Committee (IDC) for the handling of complaints and disputes raised by an insured against an insurance company in respect of an insurance claim. Under article 101 of Federal Decree-Law No. 48/2023, the IDC has been replaced by the Banking and Insurance Dispute Resolution Unit (BIDRU).
The BIDRU is an independent juristic personality, established for the purpose of receiving and resolving complaints against insurance companies. The BIDRU is now the first step in any resolution of a complaint involving insurance contracts, works or services. Complaints are made to the BIDRU by way of an online submission on the Central Bank of United Arab Emirates (CBUAE) website.
