Most of the laws referenced in this chapter are relatively new, including the Civil Transactions Law, which came into force on 16 December 2023. As such, most of the laws have not been scrutinised by the courts and it will take time before their precise application and interpretations are known. The interpretations of laws in this article are based on BCLP’s experience in the region and work in Saudi Arabia. Contracting parties are advised to seek legal advice when applying the new laws to their projects and contracts.

Until recently, international designers and contractors setting up in Saudi Arabia required a local partner. Companies in Saudi Arabia can now be 100 per cent owned by international investors.
