Under Egyptian Maritime Law, ownership of a vessel under construction remains with the shipbuilder until the vessel is delivered and successfully tested by the purchaser (the shipowner), in accordance with article 15 of the Egyptian Maritime Code No. 8 of 1990. This provision reflects the default legal position that title does not pass until the ship has been completed, delivered and accepted.

However, the same article provides flexibility, allowing the parties to contractually agree on a different timeline or conditions for the transfer of title. Therefore, the parties are permitted to stipulate, for example, that title passes at a specific stage of construction or upon payment of a particular instalment, so long as such agreement is clearly documented in the contract and does not conflict with public order provisions.
