The Bankruptcy and Composition Law (Bahrain Law No. 11/1987) (the Bankruptcy Law) and Commercial Companies Law (Bahrain Decree-Law No. 21/2001), as amended, (the Companies Law) comprise the legislation that applies to bankruptcies, reorganisations and insolvency matters in Bahrain. There are separate insolvency rules for financial institutions (commercial banks, investment banks, insurance firms, etc) licensed by the Central Bank of Bahrain (CBB) under the Central Bank of Bahrain and Financial Institutions Law 2006 (the CBB Law). However, the Bankruptcy Law and Companies Law will still apply to such financial institutions to the extent that they do not conflict with provisions of the CBB Law. There are other laws that contain provisions that may indirectly relate to insolvency proceedings including the Civil Code (Bahrain Decree-Law No. 19/2001) (the Civil Code) and the Civil and Commercial Procedures Act (Bahrain Decree-Law No. 12/1971).
