This case involved payment of wages, holiday pay, pay for public holidays, an air ticket and repayment of visa fines as the employer had not obtained a visa for the employer. A key issue was whether there was evidence the employee had worked for this company or had worked for another business. Also considered was the impact of the employer's failure to keep proper records on calculation of what was due.

Background

The Claimant was Lorenzo an individual filing a claim against the Defendant regarding his employment at the Defendant company.

The Defendant is Lilith Restaurant and Lounge, a company registered in the DIFC.

The underlying dispute arose over the employment of the Claimant by the Defendant pursuant to an offer letter dated 14 December 2019.

On 14 April 2022, the Claimant filed a claim with the DIFC Courts’ Small Claims Tribunal seeking various alleged employment entitlements in the sum of 55,040 AED .

A Consultation was held before the SCT Judge but the parties were unable to reach a settlement.

The Claimant’s monthly salary as per the Offer Letter was set out to be the sum of 1,800 AED per month.
