DCC 424/2021

This case involved a claim against some heirs of a man who had been a partner and general manager of a business. It was claimed the deceased had ordered increases of his own salary without proper authorisation and had appointed his children as employees without authorisation. The salary increases had been signed by other partners. The general manager had authorisation to appoint employees and his children's salaries had been documented in the annual audited accounts which were signed off by the other partners. There was no evidence of a requirement for other authorisation procedures. The right of the heirs to the deceased's end of service gratuity was also considered.
