This case involved non-payment of a contract employee of payments which had been agreed to be made before they came under contract and contracted salary payments. Also considered was whether a delay in setting up an entity by the owner of the employing company should be consider grounds to dismiss an investment agreement they had with the employee.

Background

The Claimant was Mahina, an individual filing a claim against the Defendants involving his employment at the First Defendant’s company and was seeking reimbursement of an amount paid as an investment to the Second Defendant.

The First Defendant was Mahfuz, a company registered in the DIFC.

The Second Defendant was Mahendra who was the owner of the First Defendant.

The underlying dispute arose over the employment of the Claimant by the First Defendant pursuant to an Employment Contract dated 8 June 2021 with a commencement date of 8 September 2021. The Claimant stated that he had made an investment with the Second Defendant of USD 30,000.
