This case involved the default of an agreement with a former employee on his retirement of an agreement which covered the repurchase of company shares, end of service payments and a non-compete clause. A key issue was whether the defendants had been properly served in Singapore and Lebanon and which court had jurisdiction. The office of one of the lawyers involved in negotiations was in the DIFC and meetings had been held there but there was what appeared to be an exclusive jurisdiction clause for the Lebanese courts to hear any dispute. Also considered was forum conveniens, and expert evidence on whether the DIFC courts should not follow that jurisdiction clause.
