DIFC 222/2021

This case involved amounts due to an employee on the termination of their employment. Issues included evidence of what their wages had been. Entitlement to holiday pay, unpaid salary, flight tickets, pay in lieu of notice and the end of service gratuity were also considered. In addition, the court looked at court fees and whether it had jurisdiction to look at amounts owed as a result of bounced cheques.

Background

The Claimant was Lingan an individual filing a claim against the Defendant on his employment at the Defendant company.

The Defendant was Lajni a company registered in the DIFC, Dubai, UAE.

The underlying dispute arose over the employment of the Claimant under an Employment Contract dated 1 May 2017.

On 27 July 2021, the Claimant filed a claim in the DIFC Courts’ Small Claims Tribunal seeking various employment claims of 998,119 AED.

The Defendant filed an Acknowledgment of Service contesting the jurisdiction of the DIFC Small Claims Tribunal.

On 4 August 2021, the Claimant amended the claim form and reduced his employment claims to fall within the financial limitations of the Small Claims Tribunal for 500,000 AED.
