This case involved unpaid salary, holiday and public holiday pay and whether a flight ticket allowance and money borrowed to pay rent should be paid. A key issue with unpaid salary and holiday pay was the employer had not properly documented these issues in the payslips so the amounts were due. A overstay fine was also payable as the defendant had agreed to pay this.
Background
The Claimant was Laxman an individual filing a claim against the Defendant regarding her employment at the Defendant company. The Defendant was Lajitti a company registered in the DIFC.
The underlying dispute arose over the employment of the Claimant by the Defendant under an Employment Contract dated 5 August 2019.
The Claimant commenced work with the Defendant on 7 August 2019.
On 24 October 2021, the Claimant filed a claim in the DIFC Courts’ Small Claims Tribunal (seeking various employment claims of 100,000 AED.
A consultation was held before the SCT Judge Hayley Norton, but the parties were unable to reach a settlement.
The Claimant’s monthly salary as per the Employment Contract was 3,000 AED per month.
