DCC 134/2015

Dubai Court of Cassation (27 October 2015) Labour Litigation Procedure – Appeal – Public order – Counterclaim – Employee's Rights – Termination – Freezone Authority

Background

In 2014 a Plaintiff filed a claim with the Dubai Labour Court asking the Defendant to pay him 574,375 AED, plus 2,000 AED for a return ticket. His claim was based on a contract of employment of an undetermined duration dated 01/12/2009 appointing him as an Administrative Manager with a salary of 14,225 AED per month which included a basic salary of 10,500 AED.

The plaintiff remained in his managerial position until termination of his contract and the expiry of an advance notice of termination on 20/11/2013.

Having not received his dues under his contract, he submitted a complaint to the competent Labour Department which referred the dispute to the Court, after exhausting all endeavours to reach a settlement.

The Plaintiff then filed his case with the Court and the Defendant filed a counterclaim asking the plaintiff to pay 1,114,820.80 AED.
