Background
A Plaintiff filed a claim asking the Defendant to pay him 661,498 AED, based on a contract of employment for an undetermined duration dated 18/09/2012 appointing him as executive sales officer for a basic salary of 38,000 AED per month basic salary (or 55,000 AED monthly salary in total).
The contract was terminated on 19/03/2014 for non-payment of salary and dues.
The details of his claim included 302,500 AED which was his salary for five months and 15 days, 82,500 AED in holiday pay, 20,498 AED for an end of service gratuity, 165,000 AED in compensation for an unjustified anticipatory breach of contract and 5,000 AED for pay in lieu of notice.
Proceedings
On 21/05/2014 the Court of First Instance rendered its judgment ordering the Defendant to pay the Plaintiff 455,896 AED.
The Court of Appeal commissioned an expert and, then reversed the appealed judgment and ordered a rejection of the claim.
On 30/06/2015, the decision of the Court of Appeal was challenged before the Court of Cassation.
