Dubai Court of Cassation (16 June 2015) Termination – Arbitrary Dismissal – Court Authority – Evidence
Background
An employee filed a case against a company and requested the Court order the company to pay them 586.988 AED and annual interest of 9%. The employee stated they had started working with the company on 09/04/2008 under an indefinite period contract and they were dismissed from their job on 30/04/2014 without legal justification. The Court ruled that the company should pay the employee 105.412.20 AED and annual interest of 9% from the date of the case was filed until the completion of the payment. The employee and the company appealed the ruling before the Court of Appeal. The Court changed the ruling and ruled that the company should pay 81,168 AED.
Decision
The employee appealed the ruling before the Court of Cassation and stated in their grounds of appeal the ruling had erred in the application of law and had insufficient evidence of causation because the court had not responded to their requests.
The Court stated this argument was invalid because the Court had established its ruling on solid reasons which were drawn from the case documents.
