This case involved whether an employer was required to provide evidence on an arbitrary dismissal of an employee where they claimed this was because of restructuring of the business. Also considered was whether the employee was due a bonus on termination.

Background

A Plaintiff filed suit No. 14/2019 against the Defendant, company, before the Dubai Court of First Instance requesting judgment to oblige them to pay him 1049,514 AED and provide a return ticket to his homeland of (3000 AED) and oblige him to pay fees and expenses on the basis that the Plaintiff had started working with the Defendant on 20/07/2016 under a two-year fixed-term contract and after the expiry of its term, he had continued to work for the Defendant under an unlimited term employment contract for a total monthly salary of 85,000 AED (the base of which was 75,000 AED). However the Defendant had dismissed him from the work arbitrarily and refrained from paying him his dues, which had compelled him to file the lawsuit, claiming his labour dues.
