Background
An employee requested the office of labour disputes settlement to order a company to pay his financial entitlements in addition to compensation. He said that the company had dismissed him from his job without legal justification. The case was referred to the court.
The court ruled that the company should pay the employee his financial entitlements including the severance payment and compensation for unfair dismissal.
The company appealed the ruling before the court of cassation. The company said in its grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. The company said that the court had ordered the company to pay the severance payment on the grounds that Bahrain Law No. 36/2012 should replace Article No. 2 of Bahrain Law No. 68/2006 and Article 111 of Bahrain Law No. 23/1976 though this reason had been invalid.
