Background

A claimant filed a case against defendants before the court. He requested the court to appoint an expert in order to consider the accounts of a players’ fund and calculate the salaries the players deserved. He requested the court to order the defendants to pay his salaries accordingly.

The court refused to accept the case because it had been filed by irrelevant party.

The claimant appealed the ruling before the court of appeal. The court dismissed the appealed ruling and ruled that the defendants should pay the claimant 17100 Dinars.

The second defendant appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that the court had ordered the club to pay the salaries although it was the commission of youth and sport who should be responsible for paying these salaries.
