Background
An employee filed a case against a company before the commission of labour disputes settlement. He said that the company had failed to pay him his financial entitlements after the termination of the contract. He requested the company to pay these entitlements. The case was then referred to the court.
The court ruled that the company should pay the employee 1986.590 Dinars.
The company appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the company should pay the employee 662.197 Dinars of the severance payment only.
The employee appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that the court had refused to order the company to pay him holiday pay on the grounds that he left the job during his probation period although he deserved holiday pay for the remaining period of the year.
