KCC 90/2018

This case involved compensation owed to a woman after she was charged for communications services although she had not signed a contract with the company. A key point was the company was liable for the failure of their employee's to check the authencity of the signature.

Background

A claimant filed a case against a company before the court. She requested the court to order the company to pay her compensation of 50000 Dinars. She said that the company claimed that she owed 22454 Dinars as a result of receiving communications services though she had not signed any contract with them in this regard.

The court ruled that the company should pay the claimant compensation 1000 Dinars.

The claimant and the company appealed the ruling before the court of appeal. The court dismissed the appealed ruling and the case altogether.

The claimant appealed the ruling before the court of cassation. She said in her grounds of appeal that the ruling had erred in the application of law. She said that she had maintained before the court that the company’s employees bore responsibility for checking the authenticity of the signature on the contract.
