This case involved the financial entitlements of an employee on dismissal. A key point was that whether the employee's contract was fixed or an unlimited one. Even though the contract was initially for one year it was to be automatically renewed after that so was an unlimited contract.

Background

An employee filed a case against a company before the commission of labour disputes settlement. He said that the company had dismissed him for his job without paying his financial entitlements. He requested the company to pay these entitlements. The case was then referred to the court.

The court ruled that the company should pay the employee 3022.074 Dinars.

The employee appealed the ruling before the court of appeal. The court amended the appealed ruling and ruled that the company should pay the employee 7790.150 Dinars.

The employee and the company appealed the ruling before the court of cassation.
