KCC 514/2015
Background
An employee filed a case against an employer before the court. She requested the court to order the employer to pay her severance pay and to return her passport. She also requested the court to order the employer to transfer her sponsorship to another employer.
The court ruled that the employer should return the passport to the employee and pay the severance pay.
The employee and the employer appealed the ruling before the court of appeal. The court dismissed the appealed ruling on the sponsorship transfer and ordered the employer to approve the transfer. The court dismissed the employer’s appeal.
The employer appealed the ruling before the court of cassation. He said in his grounds of appeal that the ruling had erred in the application of law. He said that he had not transferred the sponsorship because the Ministry of Social Affairs and Labour had refused to approve the transfer.
