OSC 396/2015

This case involved payment of compensation and reinstatement of an employee who had his employment terminated without justification. This was irrelevant as the employee was dismissed before the financial difficulties.

Background

An employee filed a case against a company before the court. He requested the court to order the company either to pay him compensation or to return him to work again. He said that the company had dismissed him from his job without justifications.

The court ruled that the company should pay the employee 5984 Rials as a compensation in addition to 352 Rials for holiday pay.

The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The company appealed the ruling before the supreme court. The company said in its grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation. The company said that they had reached a settlement agreement with their employees because they had faced financial challenges but the employee had refused to accept the settlement.
