K - Requirements, Role and Liability of Arbitrators in Onshore UAE, ADGM and DIFC Arbitration

The UAE recently revamped its legislative and regulatory arbitration framework with the introduction of Federal Law No. 6/2018 On Arbitration and Cabinet Resolution No. 57/2018 Concerning Executive Regulations of Federal Law No. 11/1992 on the Civil Procedure Law. Federal Law No. 6/2018 is a long-awaited milestone in the MENA Region filling, 'the large gap caused by the long absence of a standalone arbitration law aligned with international best practices and standards.'*[1]

Introduction

With the recent amendments to its arbitration chapter in Federal Law No. 11/1992, the prospects of arbitration in the UAE is undoubtedly positive2. The UAE Arbitration Law provides for explicit provisions on the requirements and authority of arbitrators. Arbitrators are considered one of the two essential actors in the process of international arbitration without which international arbitration would not exist*[2], and therefore, the importance assigned to the requirements and role of arbitrators in the new UAE Arbitration Law is justified.
