The DIFC Employment Law (DIFC Law No. 2/2019) was published in June 2019 and came into force on 28 August 2019. This commentary highlights what this means for employers in the DIFC and the impact of the key changes introduced.DIFC Law No. 2/2019 was introduced following a consultation process that took place in 2018, following the issue of the Draft New Law (DIFC Law No. 8/2018).DIFC Law No. 2/2019 contains significant amendments to the previous DIFC Employment Law DIFC Law No. 5/2004 and there have been revisions to DIFC Law No. 8/2018.The key changes to keep in mind are the following.

Scope

  • DIFC Law No. 2/2019 extends the application of the law to short-term employees and part-time employees (with regards to certain provisions). Article 4 of DIFC Law No. 2/2019 sets out the applicability of the 2019 law.

Waiving statutory rights
