Ministerial Decision No. 11/2015 On the Issuance of the Implementing Regulation of Cabinet Decision No. 17/2010 on the Regulation of the Use and Exploitation of Federal Roads and Facilities

Pursuant to Federal Law No. 1/1972 On the Competencies of Ministries and the Powers of Ministers, and its amending laws;

Pursuant to Federal Law No. 21/1995 Concerning Traffic;

Pursuant to Cabinet Decision No. 17/2010 On the Regulation of the Use and Exploitation of Federal Roads and Facilities, particularly Article (12) thereof; and

Based on the requirements of work interest and public interest, and to ensure the proper regulation of workflow;

It was decided as follows:

Article 1

The provisions of the Implementing Regulation of Cabinet Decision No. 17/2010 On the Regulation of the Use and Exploitation of Federal Roads and Facilities attached to the Decision shall apply to all users of federal roads, whether public and private entities, bodies or establishments or individuals.

Article 2

This Decision shall be implemented and it shall come into force three months from the date of its publication in the Official Gazette.

Cabinet Decision No. 12/2021 dated 24/01/2021 On the Fees for Services Provided by the Ministry of Energy and Infrastructure was promulgated and it provided in Article 16 thereof for the abrogation of Cabinet Decision No. 17/2010 On the Regulation of the Use and Exploitation of Federal Roads and Facilities. However, Article 16 thereof did not provide for the abrogation of Ministerial Decision No. 11/2015 dated 07/01/2015 On the Issuance of the Implementing Regulation of Cabinet Decision No. 17/2010 On the Regulation of the Use and Exploitation of Federal Roads and Facilities. Therefore, to avoid discretionary interpretation, and whereas no new implementing regulation has been issued in this regard, we have not abrogated this Ministerial Decision.Moreover, Article 15 of Cabinet Decision No. 12/2021 dated 24/01/2021 stipulates the following: "1- The Minister shall issue the nec essary decisions for the implementation of the provisions of this Decision. 2- The Minister shall designate the federal roads and facilities to which this Decision shall apply."
