We Isa bin Salman Al Khalifa, Emir of the State of Bahrain,

Pursuant to the perusal of the Constitution;

Bahrain Emiri Order No. 4/1975;

Bahrain Law No. 23/1976 on Labour in the Private Sector;

Bahrain Law No. 13/1975 on Retirement Pensions and Benefits for Government Employees and Workers;

Bahrain Law No. 1/1975 determining the Fiscal Year, the Rules for Preparing the General Budget, Monitoring its Implementation, and the Final Account; and

Based on the proposal of the Minister of Labour and Social Affairs, and after the approval of the

Council of Ministers,

We hereby issue the following Decree:

Article 1

The provisions of the attached Law shall apply to the regulation of social insurance.

Article 2

Any provision that contradicts the provisions of this Law as regards those subjects thereto shall be abrogated.

Article 3

The Minister of Labour and Social Affairs shall issue the regulations and decisions necessary for its implementation, and they shall be considered as necessary executive measures.

Article 4

Ministers - each within his own scope of competencies - shall implement this Law. The present Law shall be published in the Official Gazette and shall come into force on the first of the month following the date of its publication.

Article 1 of Bahrain Decree-Law No. 20/1986 dated 27/08/1986 states that the share to which the employer subject to the provisions of the Social Insurance Law promulgated by Bahrain Decree-Law No. 24/1976 is committed to pay to the Social Insurance Organisation and equal to 11% shall be reduced to 7% of the wages of his insured workers, and the share that the insured subject to the provisions of this Law is committed to pay to the Social Insurance Organisation shall be also reduced to 5% of his monthly wage, all of that as regards contributions for insurance against old age, disability and death.Any text in this Law that contradicts this provision shall be abrogated.

Article 3 of Bahrain Decree-Law No. 15/1987 dated 18/11/1987 states that from the date of entry into force of this Law, old-age pensions that are paid by the Social Insurance Organisation at the time this Law comes into force shall be modified on the basis indicated in the preceding first article, with no payment of financial differences from the period preceding the date thereof.The aforementioned Organisation shall bear the modified old-age pensions according to the preceding first article, as well as old-age pensions due to the insured after the implementation of this law, which exceeds the amount that the insured had obtained in contravention of Article 136 before it was amended in the manner indicated in the preceding second article of this Law.

Article 5 of Bahrain Law No. 40/2006 dated 30/07/2006 states that if the worker at the time of entry into force of this Law works for more than one employer, then he shall continue to be subject to insurance with the employer who pays the higher wage and shall stop the insurance with other employers, unless the insured requests the Organisation, by virtue of a registered letter, to continue to be insured with another employer, within six months from the date of issuance of this Law.The pension or compensation in this case is calculated for the branch of insurance against old age, disability, and death for the period prior to the promulgation of this Law, independently of the period subsequent thereto. The final pension or compensation is determined by the amount of the total of the two pensions or compensation resulting from the calculation of each period separately, as the case may be, unless the calculation of the pension or compensation for the sum of the two periods without interruption is more suitable for the insured.

Article 5 of Bahrain Law No. 6/2007 dated 21/06/2007 states that the pensions due from the Social Insurance Organisation shall be modified in accordance with the provisions of this Law, starting from the date of its entry into force, regardless of the date of maturity of those pensions, with no payment of financial differences from the period preceding the date thereof.

Article 2 of this Law states that as of the date of entry into force of this Law, all pensions paid by the Organisation shall be amended according to the provisions of Article (136) of the Social Insurance Law promulgated by Bahrain Decree-Law No. 24/1976, with no payment of financial differences from the period preceding the date thereof.

Article 1 of Bahrain Law No. 27/2011 on 07/26/2011 states that the minimum retirement pension for a pensioner subject to the provisions of the Social Insurance Law promulgated by Bahrain Decree-Law No. 24 of 1976 shall be 200 BD per month, and all due pensions shall be raised before the issuance of this Law to the extent indicated hereabove, except in the case of the pension due for partial occupational disability, with no payment of any financial differences for the period preceding the date of its entry into force.The application of the provisions of this Law with regard to pensions that are due after the date of its entry into force is limited to cases in which the male or female Insured reaches the age of fifty-five or more upon being referred to retirement, and to cases of natural death, death caused by injury, natural total disability or total disability caused by injury.If the age of the pensioner is less than fifty-five upon his retirement, then this increase shall take effect from the day following the date of reaching the age of fifty-five, or from the day following his death or total disability before reaching the said age.Article 2 of the same Bahrain Law No. 27/2011 states that the State's general budget shall bear the financial costs of implementing the provisions of this Law.

Article 2 of this Law stipulates that: the term “Minister” shall replace both expressions “Minister of Labor and Social Affairs” and “Minister of Labor”, wherever mentioned in the provisions of the Social Insurance Law issued by Bahrain Decree-Law No. 24/1976.The expression “fifty-five” concerning the insured persons shall be replaced with “sixty” wherever mentioned in the Social Insurance Law issued by Bahrain Decree-Law No. 24/1976.The expression “Kingdom of Bahrain” shall replace “State of Bahrain”, and the term “Kingdom” shall replace “State” wherever mentioned in the provisions of the Social Insurance Law issued by Bahrain Decree-Law No. 24/1976, thus a mention is in order.

Bahrain Decree-Law No. 15/1987 amending some provisions of the Social Insurance Law issued by Bahrain Decree-Law No. 24/1976 and all its implementing decisions was abrogated by virtue of Article 9 of Bahrain Law No. 14/2022 dated 18/04/2022, thus a mention is in order.

The text of Article 7 of this Law stipulates: “the provisions of replacement of Article (34) of Article 1 of this Law shall not apply to the insured person who is entitled to the pension upon enforcement of this Law, unless after the lapse of one year from the date of its enforcement”.The provisions of replacement of Clause (3) of Article (34) mentioned in Article 1 of this Law shall not apply to the persons whose service has ended before enforcement of this Law”. Thus, a mention is in order.
