In December 2014, Egypt enacted a new Renewable Energy Law (Egypt Law 204/2014) [Egypt Law No 203/2014 Concerning the Promotion of the Production of Electricity from Renewable Energy Sources, Official Gazette No. 51 of 21 December 2014 p. 3 to 7]. The law is a major step towards establishing a comprehensive legal framework for renewable energy projects in Egypt. The law compliments the feed-in tariffs for renewable energy projects previously enacted in October 2014 (Egypt Decree 1947/2014).
1. Shortcomings of the Existing Legal Framework
Previously, there was no comprehensive legal framework for renewable energy projects in Egypt. Although the first wind farm in Egypt was implemented as early as 1993, and the first tender for private financed renewable energy projects (on a BOO, or build, own and operate basis) was launched in 2009, Egypt has lacked a comprehensive and cohesive legal framework. In particular, potential international investors viewed the lack of a sound legal framework as a major shortcoming.
