This case involved whether a power of attorney given to some lawyers in an arbitration case also gave them the right to request the arbitrator rule on lawyer's fees. Also considered was the impact on the arbitral award of the invalidity of part of the award.

Background

A Respondent filed suit No. No. 10/2019 before the Dubai Court of Appeal against the Appellants requesting to have an arbitration award issued in arbitration case No. 143 of 2016 by the Dubai International Arbitration Centre (DIAC) annulled. The award had ruled to compel the Plaintiff to pay the Defendant' attorney's 'fees, and as a precaution, he requested that the award be annulled due to it having the arbitrator's signature done outside the Emirate of Dubai. The Plaintiff explained that they had filed the aforementioned arbitration suit to compel the Defendant to pay f 4,200,000 AED resulting from  consulting work implementing a contract concluded between them on 30 August 2014. DIAC appointed an arbitrator who began the arbitration procedures in Dubai and the parties signed the terms of reference for the arbitration that defined the procedures to be followed during all stages of the arbitration.
