This case involved a hotel fire. The insurance company after paying the property owner's claim relied on a subrogation contract to file a suita against a number of main and subconsultants who had been involved in the property's construction and maintenance. A key issue was whether the court had jurisdiction against all the defendants as some of the contracts included arbitration clauses but others did not.
Background
The insurance company for a hotel in Dubai which had gone on fire in 2015 agreed to settle an insurance claim with the owner of hotel that went on fire in 2015 for 1,220,000,000 AED.
Subsequently, the Insurer relied on a subrogation contract which had been signed with the hotel owner to file a law suit against six parties which were main and sub consultants who were involved in the construction of the hotel and maintenance work to recover the amounts they had paid to the owner.
