The original case involved a request to validate a contract to build a property and transfer title to the proper because of non-payment. The fact there was an arbitration clause did not mean the court had no jurisdiction to hear a precautionary attachment request. This dispute could be subject to arbitration even though it involved a property as it was about the contract not special rules on property.
Background
An Appellant filed lawsuit No 4440/2014 Sharjah demanding the validity of a contracting agreement signed on 21/10/2012 for the completion of the construction of the building No 1230/D and transfer of 30% ownership share according to market prices.
