The initial dispute involved construction work which was stopped by the planning authorities. A key issue was that it was claimed the individual who had sold the property did not have a right to do so as they had bought from an individual who had been gifted the land by the state and did not have the right to sell it. Areas considered included joint liability for compensation, how compensation was calculated and if interest was due.

Background

The Appellant constructed on a property and was surprised when the construction was stopped by the municipality for not having a construction license demanded by the First Respondent who denied giving him the authorization to use the property. The matter was presented before the Directorate of Town Planning and Survey which concluded that they should go to Court.
