Background
In 1998, the first Respondent sold to the two Appellants by virtue of an oral contract land on which he was supposed to build a villa for them.
The parties agreed on concluding a false rent contract.
By virtue of the fictitious contract, the Appellants were given the right to occupy the real estate and in return, the second Appellant should teach the children of the Respondents.
In 2006, the document allowing the occupancy of the property by the Appellant ended, however the Appellants refused to leave and converted the place into teaching rooms and realized the benefits.
Proceedings
Claim no. 867 of 2006 before the first instance court of Al Sharjah.
The Appellants requested to prove the false nature of the rent contract and the existence of the oral sales contract.
The Respondents filed a counterclaim requesting the payment of a part of the benefits and the delivery of the property.
