Public Transport – Vehicle Ownership – Business – Evidence
This case involved who owned vehicles and other assets of a public transport company. Only a national could have a public transport license however this did not mean it was automatically proven they owned the vehicles. The case also considered if proof of ownership had to be in written form. As one of the parties had secretly seized all the documents this was not required.
Background
The Respondent filed action No 9/1998 against the Appellant demanding that his ownership of some equipment, machinery, and cars be established and an expert be appointed to examine them and value them at the time of seizure and that he should pay the amount the expert concluded with interest rate until payment and the establishment of a provisional seizure of the equipment and machines.
The Plaintiff explained that the Appellant was the owner of a commercial license for public transportation issued by the Sharjah municipality.
