This case involved which courts had jurisdiction to hear a case when the parties lived in one emirate but had conducted their business in another. It also looked at the validity of the expert report when some parties had not been notified of the expert's investigation.

Background

A Respondent bank filed suit No. 33 of 2002, against the Appellants requesting the payment of 406,862.24 AED with interest from the date of filing the lawsuit until payment, on the basis that the bank had granted the First Appellant with the guarantee of the Second and Third Appellants banking facilities, but they had not paid the bank its dues.

Court of first instance - Decision no 33 of 2002

The Court of First Instance appointed an expert in the case, and after depositing his report, the Court obliged the Appellants to pay the Respondent 401,109 AED and 13% interest. The Appellants appealed this judgment.

Appeal Court - Appeal No. 87/2003 - Decision dated 19/4/2003.

The Appeal Court confirmed the appealed judgment. The Appellants appealed further.
