Background
The Commission of the Commercial Papers ruled a defendant should pay 3600000 Riyals plus a fine of 500 Riyals for issuing a cheque which had bounced.
The defendant made a plea against the ruling.
The Legal Commission of Trade Ministry (SLCTM) stated the case file revealed that the ruling was not signed by all members of the commission which meant that the ruling should be deemed invalid in pursuant with Article 512 of the Law of Commercial Court. The SLCTM also stated that the ruling was restricted by one condition in violation to the general rule which stipulated that the ruling should be final.
The SLCTM accepted the plea and ruled that the ruling issued by the Commission of the Commercial Papers should be dismissed and referred the case to the commission for reconsideration.
