This case involved an employee's dues including late salary, holiday pay and end of service gratuity. The fact the employee had taken an oath and their length of service had an impact on the amount due.

Background

An employee filed a case against a company before First Instance Authority for Settlement of Labour Disputes (FIASLD) requesting the company to pay his dues.

The FIASLD ruled that the company should pay the employee 1600 Riyals for 16 days salary in addition to 63000 Riyals for holiday pay and 45666 Riyals for end of service gratuity.

The employee and the company appealed the ruling before the SLHASLD.

Decision

The SLHASLD said that the case file revealed that the employee had made an oath on his late salary and annual leave. The SLHASLD said that the employee only deserves a third of his end of service gratuity and he had not completed five years in his post.

The SLHASLD amended the appealed ruling and ruled that the company should pay the employee 408591 Riyals for late salary, 119250 Riyals for holiday pay, 24000 Riyals for travel tickets and 19000 Riyals for the end of service gratuity.
