The original case involved a request by an employee for their labour entitlements. The employer had filed a report that the employee was working for another employer and had never worked for them although they were the sponsor. No employment relationship was proven and no money was due.

Background

An employee filed a claim with the First Instance Authority for Settlement of Labour Disputes (FIASLD) in Asir against a company asking for his labour entitlements.

The FIASLD issued a ruling ending the work relationship between the two parties and requesting the employer to pay the employee 12900 Riyals and to deport the employee with costs met by the employer.

Decision

The employer filed an appeal before the SLHASLD. The SLHASLD examined the case and said that the employee stated before the FIASLD that his sponsor, the employer, had notified the authorities that the employee had run away. The employee had also admitted that he had never worked for his sponsor since arriving in the country but was actually working for another party which meant there was no employment relationship between this employee and the employer.
