Termination of Employment – Unfair Dismissal – Redundancy
This case involved a request by an employee for reinstatement. The dismissal was fair as it was due to redundancy.
Background
An employee filed a case against a bank before the First Instance Authority for Settlement of Labour Disputes (FIASLD) requesting the bank to reinstate him.
The FIASLD dismissed the case. The employee appealed the ruling before the SLHASLD.
The SLHASLD said that the case file revealed that the bank had dismissed the employee due to restructuring of the positions and so the dismissal decision was justified.
Decision
The SLHASLD upheld the appealed ruling.
