SCSLD 432/1/1490/2011

This case involved a request by an employee for his dues. On appeal the amount due to the employee was reduced as it was proved the employee had signed a settlement and an amount had already been transferred.

Background

An employee filed a case before the First Instance Authority for Settlement of Labour Disputes (FIASLD) in Riyadh against an employer requesting they pay his labour entitlements.

The FIASLD issued a ruling requesting the employer to pay the employee 13781.44 Riyals and that the employee be deported with costs met by the employer.

Decision

The employee filed an appeal before the SLHASLD, which examined the case and stated the two parties had settled the dispute as documented in the meeting minutes of a settlement on 04/08/2009 and the settlement included 72351.35 Riyals which was to be paid to the employee. The employer confirmed through its representative that 15,000 Riyals had been transferred to the employee's country which was also admitted by the employee and as such the remaining amount was 57351.35 Riyals.

The SLHASLD issued a ruling amending the appealed ruling by requesting the employer to pay the employee 57351.35 Riyals and upheld the remaining parts of the ruling.
