This case involved an employee who was dismissed for poor performance. The dismissal was unfair as the employer had not followed the necessary notification procedures.

Background

An employee filed a case against a bank before First Instance Authority for Settlement of Labour Disputes (FIASLD) requesting the bank reinstate him and pay his salary.

The FIASLD ruled that the employee should be reinstated and that the bank should pay his salary for the period of dismissal.

The bank appealed the ruling before the SLHASLD and said in its grounds of appeal that it had dismissed the employee from his post due to his weak performance.

Decision

The SLHASLD said that the case file revealed that the employee did not receive any warning from the bank on his performance and he did not receive notice before the dismissal. The SLHASLD deemed the dismissal decision unjustified.

The SLHASLD amended the appealed ruling and ruled that the bank should pay the employee 9000 Riyals for compensation.
